IMAGE DELIVERY: Session Images will be delivered within 7 days of your session date, using the email address you provided, via digital download unless otherwise stated or a USB purchased separately. Images are purged within 90 days from session date unless previous archiving agreement has been made. Images may be archived for one year for $100 in a separate agreement. Client is responsible to download, save, backup, store, protect, and archive all images once delivered and Photographer is not held responsible for any lost images or files once delivery has been made. Due to the custom nature of each session, all sales are final. RE-SHOOTS: Re-shoots are at the discretion of the photographer and are not given for regretful personal choices such as hair and clothing choices. COPYRIGHT: Sara Boulter Photography reserves the right to use images for display, publication or other purposes. Copyrighted images may not be digitally manipulated. All images remain the exclusive property of Sara Boulter Photography and client is given print release only. AGREED TIME: Completion of the desired photographs depends on all participants’ prompt readiness at the arranged time. Any tardiness from this time may result in omission of photographs, although the Photographer will make every effort to complete the desired shots within the scheduled time frame. Time begins and ends at stated times listed above. If client is late to the point of achieving the desired images from being taken, Sara Boulter Photography, shall not be held liable for lack of time to take desired photographs. While every attempt is made to create the best images possible, no particular photo is guaranteed. RETOUCHING: Retouching, beyond the basic editing for each photograph, will be subject to an additional fee of $25 per photo. COOPERATIVE SPIRIT: Both parties agree that the cooperation and communication for the best possible result within the definition of this assignment is the paramount consideration. FORCE MAJEURE CLAUSE: If Photographer cannot perform this agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, pandemic, epidemic, or other cause beyond the control of the parties such as illness or injury, then Sara Boulter Photography will waive all change fees and apply all monies paid as a credit to a new date/invoice/contract, and shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. COVID-19: If client, photographer, or any person(s) associated with this agreement test positive for COVID-19 or are exposed to the COVID-19 within 14 days of the agreed session date, no refunds shall be given. Sara Boulter Photography will waive all change fees and apply all monies paid as a credit to a new date/invoice/contract, and shall have no further liability with respect to this agreement. CANCELLATION: If the client wishes to outright cancel the contract or chooses a reschedule date that the photographer is unavailable for, all non-refundable fees paid to the photographer will be held as liquidated damages per the contract. This Agreement incorporates the entire understanding of the parties and is governed by the laws of the State of Utah.
